Vendor Advocacy
FOR LEGAL PRACTITIONERS, MEDIATORS AND FINANCIAL ADVISERS
An independent framework for managing property sales arising from relationship breakdown, deceased estates and financial disputes.
Independent · Expert · Documented
When a matter needs a property sold
When a legal, mediation or financial planning matter needs a property sold, whether under consent orders, a grant of probate or a financial agreement, appointing an agent without independent oversight can leave the managing practitioner with an undocumented, disputed and emotionally charged sale.
Melbourne Property Advisory's Vendor Advocacy service takes that risk off your desk. We manage the sale from agent selection to settlement, keep client emotion out of the process, and make sure every step is documented and consistent with any valuation evidence or orders on file.
Our approach
Independent agent tender and strategy
-
Performance audit. We identify and vet selling agents with a proven record in the property's suburb and price bracket, removing any perception of bias in the selection.
-
Proposal vetting. We require formal written proposals from each agent, check the fine print, and unpack commission structures on your client's behalf.
-
Written strategy report. A concise recommendation matrix goes to all parties and their advisers, giving you a documented record of how the agent was chosen.
-
Discretion. We disclose only what the campaign needs. Personal circumstances are not passed to agents without consent, not used in marketing and never made public.
Coordinated pre-market presentation
-
Presentation assessment. We work with an independent stylist on lighting, staging and presentation, tailored to the client's circumstances and budget, so the solicitor, adviser or executor does not need to attend site.
-
Trade networks. We use the appointed agent's local trade network for gardening, maintenance and presentation work at competitive rates, protecting the net proceeds for the estate or the parties.
Single-point communication and reserve protection
-
Reserve price advice from a Certified Practising Valuer. Reserve advice is led by Joe Stinear AAPI CPV, an active and experienced Certified Practising Valuer. Reserve recommendations are based on formal valuation methodology, independent of the agent's appraisal, and agreed by all parties before the property goes to market.
-
Simultaneous reporting. Identical campaign updates go to all parties and advisers at the same time, so no one gains an advantage from selective or delayed reporting.
-
Single point of contact. We are the selling agent's only point of contact throughout the campaign, which protects your staff and your clients from unsolicited or uneven agent contact.
-
Campaign method. We give an objective written recommendation on public auction, private boardroom auction or expressions of interest, based on current conditions and local buyer expectations.
Records and independence
-
Contemporaneous records. Every recommendation, instruction and approval is documented in writing, giving a complete, auditable record from first instruction to settlement.
-
Compliance-ready structure. Both retainer options are structured to meet disclosure and independence obligations across family law property matters, deceased estate administration and financial planning engagements.
Two pathways. No hidden interests.
Option A: Fixed-Fee Pathway (preferred engagement)
For matters that need complete structural independence from the selling agent, including contested estates, litigated property settlements and matters where a court or tribunal has directed independent oversight. Melbourne Property Advisory is retained directly by the parties on a fixed fee tailored to the matter, based on our level of involvement and its complexity. We accept no referral fee, commission share or benefit from the selling agent, which gives a clear record of independence for any court, tribunal or regulator.
Option B: Commission-Share Pathway (conjunctional arrangement)
Our firm preference is to be engaged directly and independently by the vendor. Where a client's circumstances make a conjunctional arrangement (sharing commission with the selling agent) the better fit, it is available. Either way, we work for the vendor, not the transaction, and our independence is maintained throughout the campaign.
In every engagement: we work exclusively for the vendor and the parties to the matter. Our recommendations are based only on our client's best interests, and our remuneration, whichever pathway is chosen, is disclosed in writing before we start.

Why independent vendor advocacy
-
Valuer-backed reserve advice: grounded in formal valuation methodology, not an agent's appraisal.
-
Protects your practice: a complete written record reduces exposure to complaints and disputes.
-
Saves time: we manage the sale from agent selection to settlement, so your team can focus on the legal or financial matter.
-
Removes bias: agent selection and campaign management are handled independently of every party.
-
Protects vulnerable clients: emotionally compromised or disputing clients are shielded from the campaign, reducing the risk of impulsive decisions.
-
Transparent fees: our fee arrangement is disclosed in writing before we start. On the fixed-fee pathway, it is independent of the sale price.
How it works with your practice
-
You call or book a time. A short, no-obligation conversation about the matter and the property.
-
We agree the engagement in writing. The pathway, our role and how we are paid are disclosed to the parties before we start.
-
We run the sale. Agent tender, written recommendation, presentation, reserve advice and campaign, with identical updates to all parties and advisers.
-
You stay informed, not involved. You receive the same updates as everyone else and a full written record at settlement. The client relationship stays with you.
Matters we help with
-
Family law property matters: property settlements, consent orders and court-directed sales where both parties need to trust the process.
-
Deceased estates: executors and administrators who need a documented, defensible sale, including where beneficiaries disagree.
-
Financial planning and accounting: clients selling to fund retirement, downsizing or restructuring, where timing and records matter.

Frequently asked questions
Who do you act for?
We act for the vendor and the parties to the matter, not for the transaction and not for the selling agent.
How are you paid?
There are two pathways, both disclosed in writing before we start. Our preferred engagement is a fixed fee paid by the parties, with no referral fee, commission share or benefit from the selling agent. Where a client prefers it, a commission-share (conjunctional) arrangement with the selling agent is available. Our independence is maintained either way.
Do you pay referral fees to lawyers, planners or accountants?
No. We do not offer referral fees or any reward for referrals.
Do I need to attend the property?
No. We coordinate presentation and access so the solicitor, adviser or executor does not need to attend site.
How does the Victorian reserve price rule affect a sale?
For auctions and fixed-date sales held from 16 October 2026, agents must publish the seller's reserve price at least 7 days before the sale. If it is not published in time, the sale cannot go ahead, and any change to the published reserve restarts the 7 days. When a sale is tied to orders or a timetable, a reserve that is set properly the first time matters more than ever.

Do you work with sellers directly?
Yes. If you are selling a property yourself, see Distressed or Urgent Sale, or get in touch and we can talk about how we can help.
Have a matter that needs a property sold?
Book a 30 minute call to talk through a current or upcoming matter. There is no obligation.
